Towards the conclusion of her first year at California Polytechnic State University, San Luis Obispo, Kristin Denise Smart (born February 20, 1977-declared legally de@d May 25, 2002) was murd*red by Paul Flores (Cal Poly San Luis Obispo).
On May 25, 1996, Smart went to a party hosted by a fellow student at Cal Poly University. After 2:00 a.m., two fellow students discovered her unconscious on a neighbor’s lawn and began guiding her back to her dorm. A third student, identified only as “Paul Flores,” joined them and assured the first two that he would return Kristin to her room securely because it was so close to Smarts. Since Smart’s disappearance, numerous searches have been made, but to no avail.
The Kristin Smart Campus Security Act was enacted after Smart went missing; it mandates that all publicly funded educational institutions in California have their security services enter into agreements with local police departments regarding cases involving or possibly involving violence against students, including disappearances. The bill received Governor Pete Wilson’s signature after passing the California State Legislature with 100% support.

Kristin Denise Smart’s parents, Stan and Denise Smart, both worked as teachers for the children of American service members, and that’s where she was born on February 20, 1977. She was one of two siblings. As a little girl, Smart relocated to Stockton, California with her family. She went to Lincoln High School in Stockton and graduated in 1995. She had been employed as a lifeguard and counselor at Camp Mokuleia in Hawaii before her abduction.
How Did Kristin Smart Went Disappear?
In 1996, Smart attended Cal Poly, which is part of California Polytechnic State University in San Luis Obispo. She went to a birthday party at a fraternity house where she didn’t know anyone on May 25, 1996, the Friday before Memorial Day weekend. Her friend had gone back to the dorms earlier in the evening, so she had to walk there and back alone.
Almost two hours into the night. Two fellow students, Cheryl Anderson and Tim Davis, who had just left the party, discovered Smart passed out in their neighbor’s yard. After helping Smart to her feet, they decided to accompany her on the short journey back to the dorm. Paul Flores, another partygoer, came over and volunteered to help the two get Smart back to her room.
Davis was the first to leave because he drove to the party from his off-campus home. Once Flores, who lived closer to Smart’s dorm, reassured Anderson that he could accompany her there, Anderson was the second to leave the group and head to Sierra Madre Hall. Flores told police that he accompanied Smart to Santa Lucia Hall, where he lives, and then left her to make her way back to Muir Hall. This was the last time anyone had seen her. When Smart disappeared, she took no cash or credit cards with her.

Who was Arrested for the Crime?
The San Luis Obispo County Sheriff’s Department arrested Paul Flores and his father, Ruben Flores, on April 13, 2021, in connection with the crime.
Investigations later concluded that Paul Flores attempted to rape Smart; however, Dan Dow, District Attorney of the County of San Luis Obispo, has stated that the statute of limitations has expired on a s*xual assault charge, but murd*r was committed in the course of rape or attempted rape justified first-degree felony murd*r charges. A judge ruled in September 2021 that the murd*r charges against Paul Flores should be dropped.
The trial was originally scheduled to begin on April 25, 2022, but was postponed when the defense’s application for a change of venue was granted on March 30, 2022.
The trial was eventually held before Judge Jennifer O’Keefe in Monterey County. On June 6 and 7, 2022, the court heard pretrial motions and made some rulings and postponed others. There were more than 1,500 people in the County who received jury summonses. Opening statements were made on July 18 after jury selection began on June 13.
