Even though Jonathan Majors might launch a defamation lawsuit against the lady who accused him of assault, he should not. She has apparently recanted her story.

The 33-year-old Creed 3 star was arrested by police in Manhattan’s Chelsea neighborhood on Saturday 25 March, and he was arraigned in Manhattan Criminal Court that evening on accusations of assault in the third degree, aggravated harassment, and attempted assault.

She is 30 years old and is believed to be Major’s girlfriend, but prosecutors claim he slapped her in a taxi, “causing severe pain and a laceration behind her ear,” and that he also put his hands on her neck, “creating bruises and substantial discomfort.”

The actor’s legal team has maintained that they are “collecting and submitting evidence” to the district attorney, including video footage and witness testimony from the driver, in the hopes that the actor’s accusations will be dropped “imminently.”

“This legal situation may be far from ended,” said New York attorney Frank Salzano, even if the woman has recanted her statements and criminal proceedings against Majors are dismissed.

Despite the fact that “Majors may seek to initiate a defamation case against the accuser for making a false public statement,” he advised that the actor should not do so.

The managing partner of Salzano Ettinger Lampert & Wilson said, “Defamation claims are always tricky because the ‘truth’ is an absolute defense, and any such claim for defamation would result in all the facts and circumstances surrounding the night in question being relevant and discoverable in any court proceeding.”

The accuser “might be looking additionally at a malicious prosecution (or) abuse of process claim,” he added, “but they are less likely outcomes given the low probability that the accuser’s assertions will be shown to be false and made with intent to hurt Major.”

In addition, Salzano said, “Situations of this nature involving public figures are very complex in nature, because on the one hand, inaction by Majors may be viewed publicly as a tacit admission of some wrongdoing, however, an affirmative claim for defamation by Majors keeps this matter in the public arena that much longer.

If Majors were my client, I’d recommend he ask for the accuser to publicly recant the statement and let it go at that rather than pursue legal action for defamation. The Hollywood star Majors is on the rise.
