Judge Charlaine F. Olmedo of the Los Angeles Superior Court declared a mistrial in a previous rpe trial in December 2022 when the jury was unable to reach a verdict. This decision was made months after the mistrial ruling.

“I find the jurors hopelessly deadlocked.”

The prosecutor’s office decided to retry Masterson, and the judge permitted attorneys to introduce new evidence that had been excluded from the initial trial. Although the actor was not charged with drugging his victims, the jury heard evidence that the women had been dosed prior to the rpe.

The new jury, composed of seven women and five men, deliberated for seven days over the course of two weeks and reached a judgment. On the third count, which said that Masterson rped a longtime lover, they couldn’t decide. The Associated Press reports that they voted 8-4 in favor of conviction.

The maximum sentence for Masterson, who is married to actress and model Bijou Phillips, is 30 years in prison, 15 years for each count of guilt.
