According to military records, he served in the Marines for four years, reaching the rank of sergeant before being released in June 2021. He received several honors when he was in the military, including the Marine Corps Good Conduct Medal.

Although it has been claimed Penny may have at one time dropped out of college to backpack through Central America, Penny’s lawyers have maintained that their client was a college student.

Penny’s personal life is unknown, but as per his LinkedIn page, he joined the Marine Corps in 2017 as an infantry assault soldier.

Following Penny’s identification, protests for justice broke out across New York City, but he was still at large. But on May 12, 2023, he surrendered following an investigation by the Manhattan district attorney’s office.

Penny was chἀrged with second-degree mἀnslaughter but did not enter a plea at his court appearance. Penny hasn’t spoken out about the case either, but his attorneys issued a statement on his behalf in which they claimed that Neely had been “aggressively threἀtening” him.

Penny’s attorneys claimed:

“Daniel never intended to harm Mr. Neely and could not have foreseen his untimely deἀth.” 

“When Mr. Neely began aggressively threatening Daniel Penny and the other passengers, Daniel, with the help of others, acted to protect themselves, until help arrived.”

His lawyers then released an additional statement the night before his arr*st, saying:

“He risked his own life and safety, for the good of his fellow passengers and the unfortunate result was the unintended and unforeseen deἀth of Mr. Neely.”

If found guilty, Penny might receive a 15-year prison term.
