On 21 March, 16-year-old Aiden Fucci, who pleaded guilty last month to first-degree m*rder in the stabbing dea†h of 13-year-old classmate Tristyn Bailey in Florida 2021, began serving his sentence.
Once evidence proved that Bailey had 114 stab wounds on May 9, 2021, the case gained national attention. Even though Fucci was only 14, he was tried and convicted as an adult.
Juvenile Court Judge R. Lee Smith has the option of giving Fucci, age 16, anywhere from 40 years to life in jail. Fucci’s first-degree guilty plea does not carry the dea†h penalty because he is a minor. It is anticipated that the sentencing hearings would continue into the week, with as many as two dozen additional witnesses being summoned.
Smith has stated he will make a sentencing decision within a week.
“I’m not going to drag this out any longer than necessary,” he said in February. “I don’t want to go through a sentencing hearing and then say, ‘All right, now I’m going to take three more weeks.”
Witnesses such as sheriff’s deputies, crime analyzers, a medical examiner, and a psychologist gave testimony on the first day of the sentencing phase, giving the proceedings the air of a mini-trial. A St. Johns County Sheriff’s Office deputy named Robert Maloney was among the first to interrogate Fucci after Tristyn went missing. Fucci stated that they had been partying at a common friend’s house until they left together at 1 a.m. and that he had returned home by 3:30 a.m. The deputy, though, brought up discrepancies in Fucci’s timeline.
He explained that he had returned to Fucci’s house for another conversation and invited Fucci to go for a ride so that he could show Fucci the route that he and Tristyn had taken. With a golf cart, his stepfather trailed behind.
Maloney claims Fucci lied several times about the date he and Fucci split up. There was an argument, he admitted at last. Maloney added, and he apologized to the court for this next part, that she grabbed his penis. He didn’t want to cheat on his fiancée, he said, so he shoved her to the ground and punched her in the head. He then reportedly left the building.
Maloney then announced that Fucci had been taken into custody. He began crying and saying, “I’m going to get arrested for bull——,” while waiting.

Deputy Sheriff Marilyn Butts was the day’s second witness. Both at the site and at Fucci’s house, she snapped dozens of images.
She mentioned that when Tristyn was located, she was carrying a $20 bill, a vape pen, a ring, and a cell phone, all of which were captured on camera. She took photos at Fucci’s house and bedroom, presumably showing blood on his Nikes, white T-shirt, and blue jeans.

He seemed unruffled, but he was being evasive. ‘This is no joke, this is your whole life, your whole life,’ his mother emphasized.
To this, he replied that Tristyn had indeed seized him. He said, “Not really, but a little,” when she probed further about his fear levels. His stepfather agreed that it was unwise to send a girl of her age out there alone.
They also did their best to coach him on his interview skills. The words of his mother, “Whatever you say will influence you,” rang in his ears.
