According to a local source, some of the suspects in the murder of LSU sophomore Madison Brooks “callously” laughed at the slurring sophomore on video.

Adult suspects Casen Carver and Kaivon Deondre Washington, both 18, and Washington’s uncle, Everett Lee, 28, appeared in a Baton Rouge, Louisiana court late Tuesday for their bond hearing on Brooks charges. Washington, a 17-year-old who was not there, and Carver and Lee are charged with third-degree rape.

Brooks, 19, was killed by an automobile in East Baton Rouge Parish, Louisiana, early on Jan. 15. Investigators detained the four males on Monday after two of them allegedly raped an intoxicated Brooks inside a vehicle before dropping her off shortly before she was struck.

Specifically, Myers said he watched a video of Brooks and the suspects from inside the vehicle, according to the report. Myers said footage, which was allegedly taken by one of the four suspects, depicted the others “callously” laughing at Brooks, who appeared to slur as she spoke, according to the report. The video reportedly did not include the alleged rape.

According to WAFB-TV, 19th Judicial District Judge Brad Myers stated he had seen the case tape during Tuesday’s bond hearing.

The report states that Myers observed a vehicle-mounted video of Brooks and the suspects. According to the report, one of the four suspects allegedly filmed the others “callously” laughing at Brooks, who looked to slur. The footage did not show the alleged rape. Myers also saw a film of Brooks falling in Reggie’s, a local bar, earlier in the night. Brooks died with a 0.319% blood-alcohol level, according to police data.

The accused’ attorneys had contended that footage indicated the victim was not inebriated enough to agree to s*x. According to FOX 8, the two suspects’ attorney Ronald Haley stated Brooks “willfully got into the car” in the footage.

“Absolutely not a rape,” he said prior to Tuesday’s hearing. “Listen, this is a tragedy, definitely not a crime.”

FOX 8 said that Brooks appeared inebriated.

According to WAVB, Myers believed the footage and other evidence proved a crime.

“To the point under the law that you say you’re in a drunken stupor, to the point that you cannot lawfully give consent or answer questions? Absolutely that was not the case,” he said.

The outlet stated that prosecutors announced they will prosecute the suspects with first-degree rape during Tuesday’s court hearing, however it was unclear if they would charge all or any of the boys. Grand juries are expected from prosecutors.

Louisiana law defines third-degree rape as s*xual activity without a victim’s permission. Myers placed Washington on a $150,000 bond for third-degree rape. Principles Carver and Lee were held on $50,000 and $75,000, respectively.

The suspects and victim were drinking at Reggie’s on Bob Pettit Boulevard, about one mile from the LSU campus, according to the four arrests.

Police records show the victim fled the bar with four guys. Carver told police Brooks asked for a ride home. He said he gave her a ride because he didn’t want to leave her intoxicated and the pub was shutting.

“He felt uncomfortable and he ‘hated it,'” he told police.

“During the interrogation, the co-defendant (Carver) was asked if the victim was too incapacitated to consent to the s*xual intercourse and he replied, ‘I guess,'” the document states.

On Friday, Feb. 3, Brooks will be visited and buried in Covington, Louisiana.
