Thus, the following part should center on Ben’s deal with abandoning the accident, potentially harming Jen, with whom he was emotionally connected, and any legal proceedings.

To TV Guide, James Marsden even discussed the prospect of Season 3 focusing on Ben’s mounting issues. As he stated, “Not only is he likely to discover that Jen is to blame for his brother’s murder, but he is also guilty of hit-and-run.

And they were the hit-and-run victims. And in the first season, his brother was involved in a hit-and-run… I believe [Ben] makes a conscious effort to look in the mirror alone and do the right thing… but occasionally, the pressures can overcome him.”
